Byron must reconsider tobacco giant’s bond reduction
Madison County Judge Nicholas Byron must reconsider his decision to reduce the size of a bond Philip Morris USA must post for its appeal of a $10.1 billion lawsuit over light cigarettes, the 5th District Appellate Court in Mount Vernon ruled Monday.

In his 12-page opinion, Justice Gordon Maag said, “Neither this court nor any court may ignore or deviate from the requirements imposed by Supreme Court rule.”

The appeals court will not enforce its ruling for 30 days while Byron reconsiders the case. Justices James Donovan and Richard Goldenhersh concurred with the opinion.

“The opinion is clear, straightforward and speaks for itself,” said Joy Howell, spokeswoman for Korein Tillery, the Belleville law firm representing the 1.1 million Illinois smokers in the lawsuit
